The Minded Institute Professional Training Terms and Conditions

This document covers the responsibilities of The Minded Institute and participants in the Minded Professional Training Ltd and Minded CPD Trainings, referred to in this document as ‘Course/Trainings’.

The Minded Institute is the umbrella term for two companies: Minded Professional Training Ltd and Minded CPD.

Data Protection

The Minded Institute respects our participants’ privacy and is committed to protecting our participants’ personal data. The Minded Institute collects certain personal data to process a participant’s order, manage the participant’s account, provide services purchased by the participant and contact the participant regarding any issues with an order. All data collection and storage procedures comply with the Data Protection Act 2018 (DPA) and UK general data protection and regulation (UKGDPR) guidance. The Minded Institute is unable to process an order without this personal data. Further information regarding the data that the Minded Institute has collected can be requested by emailing support@themindedinstitute.com with the subject line ‘data protection query’.

Training Timing and Booking Confirmation

All training times refer to UK Time, which is GMT or BST depending on the time of year. Many of our trainings are held online, while others are held in person; please ensure the mode of delivery of the course booked is understood.

Upon booking an online course, the participant will receive an automatic booking confirmation with the link to access the live training and any required handouts. If for any reason this email does not reach the participant’s inbox or junk folder within 24 hours, the participant must contact The Minded Institute as soon as possible. The Minded Institute is unable to issue refunds or transfer fees to any other course including the same course held on an alternative occasion. Course Fees and Cancellation

Bookings are only confirmed once The Minded Institute has received full payment. The Minded Institute is unable to reserve spaces prior to payment. By booking on behalf of another participant, the person making the booking confirms they are authorised to make the booking.

Any course fees paid are non-transferable to any other course, including the same course held on an alternative occasion.

The Minded Institute may accept the transfer of a booking to an alternative participant if the following stipulations are met.

The new participant meets and can evidence that they hold necessary pre-requisites for course attendance.

The transfer of the place is the sole responsibility of the participant who originally booked.

The participant must inform The Minded Institute of this transfer no less than 7 days before the course commences. No transfer of booking will be accepted less than 7 days prior to course start date.

The Minded Institute may offer a bespoke payment plan on a case by case basis. When entering a Payment Plan, upon paying the first instalment, the participant is committing to pay the full course fees, and the above cancellation terms apply.

Although all efforts are taken to avoid cancelling a course, in unforeseen exceptional circumstances The Minded Institute may be required to cancel trainings. In the event of course cancellation, The Minded Institute will refund the total course fees paid within 14 days of cancellation. The Minded Institute shall not be liable to pay for any additional expenses incurred such as travel and accommodation costs. The Minded Institute advises to participants ensure they have sufficient travel insurance in the unlikely event of a cancellation.

Although all efforts are taken to avoid changing a course date, in unforeseen exceptional circumstances this may occur, and The Minded Institute reserves the right to do so. Under these circumstances The Minded Institute will provide the participant with notice by email and the participant shall have 7 days to request a course fee refund. If a course fee refund is not requested within 7 days, the participant will no longer be eligible to receive a refund. If changes occur within 7 days or less before the training commences, the participant is eligible for a course fee refund up until 24 hours before the training commences.

In unforeseen exceptional circumstances the Minded Institute may be required to offer the course at an alternative venue, and The Minded Institute reserves the right to do so. Should this change still offer tuition in person and within 4 miles of the originally advertised venue, refunds are not provided. If the alternative venue is more than 4 miles from the originally advertised venue, or if the course is moved online, The Minded Institute will provide notice by email and allow 7 days to request a full refund. If a refund is not requested within 7 days, the participant will no longer be eligible to receive a refund.

If, during the course, The Minded Institute, a Guest Lecturer or Course Facilitator is concerned about the physical or psychological wellbeing of a participant or their ability to complete the training, The Minded Institute reserves the right to ask participants to leave the course. Under these circumstances The Minded Institute will refund 50% of the course fee.

If a participant is unsure if the training is appropriate for them, please contact The Minded Institute and a member of the team will answer any questions and provide guidance on the suitability of the training.

The Minded Institute will not tolerate any threatening or abusive language or behaviour towards its staff or participants. Participants engaging in this behaviour will be asked to leave immediately and no refund will be provided If the behaviour of a participant is viewed by the Minded Institute tutor as disrupting the ability of other participants to learn, The Minded Institute reserves the right to ask participants to leave. No refund will be provided under these circumstances.

If circumstances change and a participant wishes to request a course fee refund, please see below refund scale:

Cancellations more than 30 days prior to a course start date are entitled to a 50% refund.

Cancellations less than 30 days prior to a course start date are non-refundable.

Course Attendance

Course attendance for the entire duration of the course is mandatory. In unforeseen exceptional circumstances attendees may miss up to 10% of the tuition hours and still receive final certification. Should the attendee exceed this amount no certificate may be issued. In the event that a participant, for whatever reason, does miss more than 10% of the course, it will not be possible to attend the same missed sessions on future course without payment. These parameters are different for the Minded Professional Training Ltd. Diploma in Yoga Therapy, guidance for which is provided in the training and conduct contract and Student Handbook.

Participants are asked to notify the Minded Institute team if unable to attend a session. Participants are responsible for ensuring they are able to attend all sessions if they wish to receive a course certificate and receive credit for attendance. No refunds will be provided in the event of a participant failing to complete the course or failing to attend all sessions.

Participants are responsible for informing the course leader of any updates to the information provided in the registration form.

Participants are responsible for arriving at least 15 minutes prior to the start time of any in-person course. If a participant has signed up for an online course, it is the participant’s responsibility to login 15 minutes before the course commences. This is to allow time to sort out any issues with joining the online session. Should the participant fail to login 15 minutes before a session and immediately notify The Minded Institute that there is an issue with logging into the online meeting, no refund will be issued if the participant misses the course due to technical problems.

Participants in online training are expected to have their video on at all times so that their attendance and participation can be assured. Should any event occur which requires the participant to turn their video off, they must first message the lecturer privately via chat to notify them that they will be turning off their video. If the participant is feeling that they need to turn their video off for personal reasons, to regulate due to being triggered for example, they must notify the lecturer prior to turning their video off and return to the session as soon as possible. In such a circumstance, cameras should only be turned off for 5-10 minutes in order for the participant to collect themselves. In exceptional circumstances a longer period may be taken, with the consent of the lecturer, but extended time with the camera turned off cannot exceed 30 minutes. This is to ensure: • the health and safety of all participants • maximised learning opportunity for all participants • consistency of training experience for all participants • participant confidentiality • participant capacity to undertake the training If a participant breaches these conditions and turns their camera off for longer than 30 minutes without first advising the lecturer and seeking their approval then the training may be suspended for that individual.
